Candidate Privacy Notice Regarding the Processing of Your Personal Data
Dear Job Candidate,
This Privacy Notice has been prepared by Seed Tourism and Hotel Services Construction and Trade Inc., acting as the data controller, in accordance with Article 10 of the Personal Data Protection Law No. 6698 (“KVKK”) and the Communique on Procedures and Principles to Fulfill the Lighting Obligation. It aims to inform you about the purposes of processing your personal data, legal reasons, collection methods, who your data may be shared with, and your rights under the KVKK.
We do not have absolute control over the information you provide in your resumes or through websites facilitating your contact with us. We advise you not to share personal data and sensitive personal data that you do not wish us to know.
1. Which Personal Data Do We Process?
• Your name, surname, date and place of birth, gender, marital status, nationality;
• Your email address, address, mobile phone number;
• Health-related information, if provided in the resume (e.g., disability status);
• Your educational background, certificate and diploma details, expertise, foreign language skills, information about your skills, seminars and course participation, computer knowledge, exam results;
• Information regarding your work experience (e.g., previous industries, companies, your position, responsibilities, salary);
• Your photo;
• Your driver’s license information;
• Information about your hobbies;
• Your salary expectations;
• Military service status information;
• Reference information (name, surname, title, workplace, contact details of the reference person);
• Other information that you voluntarily add to your resume which we may not foresee, will be processed in accordance with the KVKK.
These data may be stored by Seed Tourism and Hotel Services Construction and Trade Inc. for up to one year if your job application is not accepted, and for up to 10 years following your departure from the company if your application is accepted.
2. What Are the Purposes for Processing Your Personal Data?
The personal data mentioned above will be processed for the following purposes related to the performance of this Employment Agreement:
• To manage your job application process,
• To communicate with you,
• To determine whether you have the necessary qualifications for the position we offer,
• To contact references and assess your suitability for the job,
• To determine your preferred position, salary expectations, willingness to work in other positions, and start date,
• To assess whether you are eligible to use company vehicles if necessary,
• To determine your age suitability for the position and comply with the Regulation on the Employment of Children and Young Workers,
• To help human resources easily remember you during the interview,
• To contact you and prepare an employee file if you are hired,
• To assess any issues that may disrupt your employment and ensure compliance with Military Penal Code No. 1632, Article 75.
3. How Do We Process Your Personal Data and Based on What Legal Grounds?
The personal data is processed through automated (e.g., automatically submitted to our system via the internet) or non-automated methods (e.g., information provided via phone and noted by us) based on the following legal grounds outlined in Article 5 of the Law:
• (i) It is necessary for the data controller to fulfill its legal obligations,
• (ii) Processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject,
• (iii) It is necessary for the performance of a contract to which the data subject is a party, or for the implementation of pre-contractual measures,
• (iv) Obtaining explicit consent.
4. To Whom and for What Purposes Do We Transfer Your Personal Data?
Your personal data may be shared with judicial authorities or law enforcement agencies to resolve legal disputes or if requested in accordance with applicable legislation. Your data may also be shared with our group companies for employment purposes.
5. What Are Your Rights Regarding the Processing of Your Personal Data and How Can You Access Them?
You can exercise your rights under Article 11 of the KVKK by submitting a written request to Seed Tourism and Hotel Services Construction and Trade Inc. via registered electronic mail (KEP), secure electronic signature, mobile signature, or the email address previously provided to the data controller and recorded in the system.
